Terms of Use

1. Purpose of the application

SpotPark is a mobile application that allows:

• Owners (individuals or professionals) to offer their parking spots for rent.
• Renters to search, book, and pay for a parking spot directly via the app.
• Secure payments through a third-party payment provider (e.g., Stripe).
• Use of geolocation to display nearby available parking spots.

SpotPark acts solely as a technical intermediary and does not own or manage any parking spaces listed in the application.

2. Access to the service

Using SpotPark requires:

• Downloading the mobile application.
• Creating a user account.
• Providing accurate, complete, and up-to-date information.
• Acceptance of these Terms of Use.

The user is responsible for the confidentiality of their credentials. SpotPark reserves the right to suspend or delete an account in case of non-compliance with these terms.

3. Owner registration

Owners wishing to list a parking spot must:

• Be legally authorized to rent the listed property.
• Provide accurate information (location, dimensions, access conditions, photos).
• Set a clear and transparent price.
• Comply with applicable local regulations.

Professionals must comply with their tax, social, and commercial obligations.

4. Booking, payment, and SpotPark commission

4.1 Booking

Bookings are made exclusively via the SpotPark mobile application. Any confirmed booking commits the renter to pay the displayed amount.

4.2 Secure payment

Payments are processed by a secure third-party payment provider (e.g., Stripe). SpotPark does not store users' bank details.

4.3 SpotPark commission

For each transaction completed via the application:

• SpotPark charges a fixed commission of 12% of the total booking amount.
• This commission is automatically deducted during payment processing.
• The owner receives the net amount after deduction of the commission and any applicable bank fees.

By using the application, owners expressly accept this 12% commission. SpotPark is not responsible for any banking delays related to financial institutions.

5. Cancellation and refunds

Cancellation conditions may depend on:

• The type of booking (hourly, daily, monthly).
• The conditions set by the owner in the listing.

Any refunds are made through the same payment method used for the booking, in accordance with the applicable cancellation policy.

6. Liability

6.1 Owner liability

The owner is solely responsible for:

• The accuracy of published information.
• The actual availability of the parking spot.
• The legal compliance of the rental.
• The safety and accessibility of the location.

6.2 Renter liability. The renter agrees to use the spot only for authorized parking, respect the booking duration, avoid damage, and follow access and safety rules. Any damage incurred is the renter's responsibility.

6.3 SpotPark liability

SpotPark provides a matchmaking application.

SpotPark is not a party to the rental agreement between owner and renter.

SpotPark cannot be held liable for disputes between users.

SpotPark cannot be held liable for theft, damage, loss, or incidents occurring during the rental period.

7. Geolocation

The SpotPark application may use mobile device geolocation data to:

• Display nearby parking spots.
• Improve the user experience.

Users can disable geolocation in their device settings, which may limit certain features.

8. Personal data

Personal data collected via the application is processed in accordance with the SpotPark Privacy Policy.

Users have the following rights, in accordance with applicable regulations (e.g., GDPR):

• Right of access
• Right to rectification
• Right to deletion
• Right to object

9. Intellectual property

All elements of the application (logo, SpotPark brand, design, database, code, content) are protected by intellectual property laws. Any unauthorized reproduction, modification, or use is prohibited.

10. Account suspension or termination

SpotPark may suspend or delete an account in case of:

• Fraud
• Attempts to bypass the payment system
• Non-compliance with these Terms
• Abusive or inappropriate behavior

Users can delete their account at any time from within the application.

11. Changes to the Terms

SpotPark reserves the right to modify these Terms at any time. Users will be informed via the application in case of significant changes.

12. Applicable law and dispute resolution

These terms are subject to the applicable law in the country where SpotPark operates. In case of a dispute, the parties agree to seek an amicable solution before any legal proceedings.
